OH RWA Legal updates on Handover Agreement
Dear Residents,
Please be apprised that Omaxe and FP were supposed to pay OHRWA a sum of Rs 9.22 crore towards IFMS and other heads, as per agreed hand over agreement which came into force wef 1st Sep 2019.
All the post dated cheques issued by them in accordance with our Handover Agreement have bounced due to non availability of funds and have been returned one by one unpaid by our banker when RWA presented those to the bank on respective due dates.
Later, out of Rs 9.22 crore total due, Omaxe/FP transferred Rs 1.4 crore only to OHRWA bank account but Rs 7.82 crore still remains unpaid by them.
Against the pending dues of Rs 7.82 crore from Omaxe/FP, we have already filed respective individual cases against Omaxe/FP under Section 138 in the court of law for all bounced cheques. Due to Covid 19 pandemic, all the dates have been postponed for September/October 20 onwards.
We have also filed for insolvency case against Omaxe in NCLT, Regional branch, Chandigarh (Because their office address is now shifted to Sohna Road, Gurgaon,Haryana) Last hearing was on 19 Feb, 2020. Later no hearing could take place due to Covid 19 pandemic & next hearing date is yet to be announced.
Please note, this is a tough legal battle which we will have to fight for our rights and we solicit support & unity from all residents in this matter of concern. We will keep the residents informed on any progress towards this matter of concern.
